2 part question: getting a divorce and wife hacked into my email account and is using this as a barging chip. Is this legal? can she do this? Can I counter claim her hacking to make it inadmissible in court?
Second part, she has recorded our conversations between her and myself with out my knowledge. Is that usable in court and legal? What can I do to stop that?

Reply:Depends if you have children and if what you said can prove that you're an unfit parent. She'll take full custody. CCCS don't give a crap.
Reply:My ex-boyfriend was married to a woman in GA and while we were dating she did the same thing to him. She hacked his account and printed off a bunch of Ebay receipts to try and get her child support raised and when the courts found out she got into his email they would not allow her to use the information in court.
His attorney informed him that hacking into email is looked upon the same way as opening anothers mail. What she has done is illegal in some states but you would have to speak to an attorney to know for sure. I hope everything works out for you!
Reply:As far as your email goes, depending on the judge he may not use them because they are hear say. There really isn't anyway to prove who wrote those emails and there are way too many possibilities.
But as far as the recordings go. The law states that only one party has to know about the recording. My advice either start recording the conversations yourself to use against her and don't say or do anything that can look bad on yourself.
Reply:I doubt your wife ''Hacked" into your e-mail. I bet she just typed the password you gave her, and in that case, your got nothing on her.

Reply:Ask your attorney, but using your e-mail as a bargaining chip is legitimate to my knowledge. My ex-wife's attorney is known to commonly do much more to get bargaining chips, from videotaping people having affairs to setting them up by paying a woman to go up and talk to them at a bar while being videotaped.
Second part varies from state to state. It would be legal and admissible where I live, and you can look it up for MO as easily as I can. In many states, as long as one person (her) consents to the recording, it is legal. In other states, both have to.
Sounds like you may want to settle out of court, which is cheapest anyway. But ask your attorney what her recordings and spyings are worth. The court really doesn't care if you call each other names, and if it's a no-fault divorce, the court doesn't care who you slept with in many cases.
Reply:Sorry to say it but its legal! I did the same to my ex wife for a bargaining chip during my divorce! Nothing you could do, you should have watched what you said and changed your passwords! Bummer for you!

My guess is she found what she was looking for in your e-mail and you probably deserve to be blackmailed.

Tell her if she tries to use the information you will have her arrested.

Reply:The e-mail isn't admissible in court and your wife could be in trouble for hacking into your account. The recorded conversations could be admissible, but it will depend on the circumstances. You need to talk to your lawyer about all of this.
Reply:A couple of things....first get a lawyer...he or she will now the answers...secondly...What did you do that she now has a barging chip...I know is some states it is legal to tape someone without their consent...you need to call a lawyer that would be the right thing to do
Reply:If she hacked your e-mail from the computer in your house YES, it's legal, yes she can do that, no grounds to counter sue.
Recorded conversations are legal as long as one of the parties being recorded has knowledge. It's legal and she can use it.
What your attorney should do is file a motion to exclude evidence basing it on coercion.
