I know my wife is doing adultry and need to prove it leagally by getting email messages recv'd and sent and activity on yahoo IM.
1. Does yahoo provide this information once subponaed
2. If she Cxl her account how long information is retained with yahoo
3. Who do I contact at yahoo to get this done.

Yahoo doesn't keep that stuff on their server--they just send it on---they don't store it. They don't have it in their possession. If they did, they could charge you to retrieve it and it's be way expensive. IMs are like txt messages--once sent and deleted--they are gone!
Reply:E-Mail is a tricky topic. From what i understand, with the current US criminal law, In certain circumstances, subopenas might not be enough. First, obtaining the subopena might be difficult in and of itself. Without a warrant, you cannot read the text of the email itself, only the header, unless the email is over 180 days old. You can only read the email itself with a warrant.
However, there are loopholes. Does she use the same computer that you do to send these e-mails and IMs? Does she keep the password to this email account stored? If so, she may have lost her expectation of privacy, and you may be able to legally read these emails. IM logs are different, if they are stored on a shared computer in an un-encrypted folder, they could possibly be considered fair game. If not, it gets dicey.
PLEASE CONSULT AN ATTORNEY BEFORE TOUCHING THE COMPUTER TO PRESERVE ANY EVIDENCE!!!!
Reply:You'd have to check with a lawyer to be sure, but I kind of doubt there is any way you could get a subpoena to access your wife's emails and IMs just because you suspect her of adultery.
I really think there would have to be suspicion that she had committed some sort of felony along with reasonable cause to believe evidence of that felony was contained within her private correspondence before Yahoo would be required to waive their privacy policy in order to cooperate with a police investigation.

However if this is an ongoing situation look into getting a keystroke tracker, it will record on the computer in question everything she types in mail or private message
